Telecom Regulatory Authority of India send notice to Idea cellular To submit 2.97 carore in Telecom Consumers Education and Protection Fund (TCEPF) .idea cellular over charges their subscribers for making calls to BSNL and MTNL networks. if we go in depth of this issue, in May 2005 department of telecom (DOT) provides licence o permit inter-service area connectivity among telecom operators within four states – Maharashtra, West Bengal, Tamil Nadu and Uttar Pradesh.
According to this You can consider this each call within these states is treated as Local Call, but some Private GSM operators were charging higher rates for calls on BSNL and MTNL compared to calls made on network of private operators within the defined boundary of these states.
ST Abbas TRAI’s adviser Said on this “…the Authority hereby directs M/s Idea to deposit the amount of Rs. 2,97,90,173 charged in excess from its subscribers during the period from May 2005 to January 2007, as computed by M/s Idea, in TCEPF and report compliance within 15 days of issue of this direction,”
after all these TRAI asked these private GSM operators to refund all the higher charges to Subscribers but Cellular Operators Association of India(COPI) and other telecom operators challenged this notice in supreme court of india in January 2015 while they continued charging higher rates to consumers.
In their favor Idea Cellular said that “the excess amount cannot be refunded to subscribers as call data records of that period are not available with it”. Then regulator TRAI directed Idea to deposit the fund in Telecom Consumers Education and Protection Fund (TCEPF)
